Asalam alaikum, I don’t work but am on benefits due to my illness and being unable to work. Do I have to pay Khums?

Answer:

*Wa Alaykum Assalam wr wb *
*Khums is obligatory on any one who has more that his lawful expenses. It
makes no difference whether you work or not if you have more than your
usual lawful expenses. Whatever more you have every year must be calculated
for Khums which is 20%.*

*Khums is obligatory on you on any amount you have after spending your
usual livelihood expenses. Khums is also obligatory on your father and
mother if they have any amount remaining with them after spending on their
livelihood expenses. If they give their Khums, it will not exempt you from
paying your own obligatory Khums. Your Khums should be paid by you not by
your parents.*

You should help your brother from your own money which is the remaining 80%
after paying the Khums. Shame Sadat is the right of deserving needy pious
Sadat who have no one to look after their livelihood needs.

Qibla AOA I have a question regarding payment of khums. I m a salaried person and will get a unified amount upon retirement. There is a madrassa in our city where yateem monin children are being looked after and given religious and worldly education. I have taken responsibility of one child and give the maulana sahib of that madrassa an amount on monthly basis. I started this by doing a niyat that I m paying this amount as advance for my khums which would be due on the money I would be getting after retirement. Is this a proper niyat and a proper way of performing my khums duty. Mola aap ko salmat rakhein. Ameen

We own an apartment in which we have lived for number of years, now we purchased a new one and intend to shift there as our primary house. The old one was the first house and khums was not paid as it was a need and used, now we intend to use the 2nd one and keep first one on rent. On which one should be paid khums, old or new or will both will be exempt?

Answer:

The house which you intend to keep for rent, is applicable for Khums.
The house which you currently reside in it is not applicable for Khums if
you bought it from money which did not remain with you for more than one
year.

Answer:

It depends on the intention of the donor. If the intention was Sadaqa for poor people, then it must be given to the poor people only. If he intention was for general charity, then it can be given to any other good cause.

The leading Maraaji' of Taqleed including Ayatullah Sistani permitted
giving half of Sahm e Imam ( AS) in this noble purpose.

If I’ve counted all my savings and set aside an amount for khums but then before actually getting the receipt for khums I spend some of the savings, do I need to subtract that amount from the khums amount and then give it or can i just give the amount I had originally set aside?

Answer:

You are not allowed to use the Khums amount before paying it. You must pay
the total 20% of all your savings on the day of Khums.

Yes of course. Every Sayed who has more than his needs for livelihood expenses must pay Khums on the savings or the amount or goods remaining with him, as Khums, once a year at least. Only poor Sayyed are not responsible to pay Khums because they are poor.

Salaamun Alaikum, I would be very grateful if you could please answer my question. I received gold jewellery as gifts during my marriage. I took out khums for the jewellery that I had not worn in the first year of my marriage. I have been married for many years, and have used my jewellery items variably, they all get used, but specific items may have been worn in some years but not in others. Since gold prices keep going up, did I need to keep taking out khums every time a year passed in which I had not worn a specific item from my collection? Thank you and JazakumAllah Khair.

Answer:

Unused jewellery need to be calculated for Khums if the price goes up and you need to pay Khums for the additional value only if you have already paid Khums for its value on the previous years.

Yes, it is allowed to make a pre payment of Khums if you are sure that the
amount which you give now is not more than the real Khums due on you on the
day of the pre payment, means this amount is already Wajib on you.

Salaam Alaikum, I would like to clarify Khums paid on money that is gifted or not earnt. My son has had a bank account since he was a baby. We put his child benefit money as well as any birthday/Eid money that he got. He has not earnt any of that money. He only earnt a minimum amount of interest paid into his account. Now that he has turned baligh, do we need to pay any khums on the money in his account? He does taqleed of Agha Seestani. Jazakallah.

Question:

Salam Aalkium I usally pay khums on 31 January every year. In november last year I paid an ammount of money for insurance, but now I will not be using that insurance anyway. The insurance company will therefore pay my money back. Will I have to pay khums of the money I get back from my insurance? And another question please. Every year the government make a calculation if you get money back due to too much paid tax or maybe you will have to pay tax back because you did not pay enough. The money they give you is based on calculcation for the pervious year. Will I have to pay khums of the money I may get back in this year or will I be paying it on 31. January?

Answer:

1. Every money you own on the date of your Khums must be calculated for Khums including the money which you have with the insurance company or bank or investing company etc.
2. If you get money from them or information that they will definitely give you an amount, Khums will be applicable on your date of Khums.

We need details about the masjid construction committee and how much they
have spent and how much they need more.

If you spend the amount on your livelihood and nothing remains, then there
will be no Khums. If it remains, the Khums is applicable on the remaining
amount only after one year from receiving it.

Answer:

If he is a poor Sayyed, then he will be entitled to receive and utilise Sahm Sadaat. Poor means : not having enough to meet his needs of food, clothing, housing, treatment etc.
You can give your brother in law from Sahm Sadaat if he does not have enough money for his treatment.
