Question ID 1336 Wednesday 30th of April 2014

Question:

Salamun Alaykum My question is pertaining to my job. But before I state the question I shall briefly explain the nature of the company I work in and my role. Our company is a Reinsurance Broker. I work in the Aviation Reinsurance Department. All our clients are based outside the UK. Our client in whichever country they are would approach a local insurance company. As the client is of aeronautical nature i.e. the insured asset mainly relates to aeroplanes or their spare parts, passengers and crew members or airports, the risk in monetary value is very big so that insurance company approaches our office in that respective country who sends us all the details here in London and we approach the London Insurance market (who have the financial strength to provide insurance for such big risks). The London Insurance Market then provides Insurance coverage to the local Insurance Company who in turn is providing insurance for the client hence this area is called Reinsurance (insurance for insurance). During the whole process we represent the original client on the London Insurance market and so we charge a brokerage fee for providing this service which is deducted from the insurance premium paid by the client. When the insurance premium (which is similar to a regular premium on regular insurances only much bigger in monetary value) is paid the local insurance company takes their commission from the brokerage received and the rest is split between us in London and our regional office who introduced us to this piece of business. In this company, my role is to prepare legal documents which are the acceptance letter (which states that the insurance coverage is fully active) the debit note (which tells the client how much they have to pay and on what dates) and a copy of the reinsurance contract (this contract is drafted by someone else and not me, I only send a copy) and after that I put everything in a file for storage in the office. One of the companies that approached our Dubai office was National Police of Bahrain who are responsible for ‘Law enforcement in Bahrain’. They were approached our Dubai office via a local insurance company in Bahrain. The Dubai office then asked us to do the normal procedure and we approached the London Market and got them the Reinsurance To add to this in this business we have a special kind of an insurance known as an ‘Excess of Loss Treaty’ where instead of an aviation company being a client the local insurance company based in another country is our client. Under the terms and conditions of the contract whatever aviation company they are providing risk to we get them insurance coverage for all those risk so it is a much bigger in terms of size and so from that we get brokerage. So under the information section the local insurance company had the following companies in their portfolio: • BAE Systems (makes military equipment for USA,UK, etc) • Air Force of Jordan • Air Force of Qatar • Oman Air Force • Sukhoi (make military air force for Russia) I do not have a choice and had to prepare the documents otherwise I will lose my job. Also this is the only problematic customers, the others clients are more than 100 and are private airlines that do not support oppressive governments What should I do, I will repent, but what other things do I need to do? Do I need to pay khums or do anything else on this as this file was only for 2 days of work out of the other working days?

Answer:

Helping the oppressor is forbidden in Islam and it is one of the major
sins, and the money taken for such job (helping the oppressor) is unlawful.
This money must be given to poor and needy and the most important point is
that such help to the oppressor Must be avoided immediately.

Question:

Salam alaikum Sayed Musawi If we are talking about someone who is not present and it is not any thing bad but how and what she organized and cooked and said etc is this also backbiting? Jazakallah

Answer:

If the person mentioned in his absence likes what is been said or at least
does not mind it, then it is not back biting. The definition of Gheebat (
back biting) is : mentioning a believer with some thing which he does not
like to be mentioned.
