It is an investment so you must calculate the amount you paid in your Khums.

Question: Mujtahid: Aqa e Sistani Topic: Khums on BC Question: My khums date this year is 1st Ramazan (28 May 2017). I have put 2 BC of Rs 5000 each for duration of 1 year. One BC (Rs 50,000)i get before 1st Ramazan (March 2017) and is fully utilized before my khums date that is 1st Ramzan (May 2017). Other one BC i get after 1st Ramzan that is in (October 2017). So how will khums work on this condition ? Do i have to pay khums on submitted amount till 1st Ramzan on my second BC (October 2017) that is 5000x5=25000 ? or Since i have no money in hand for my second BC on khums date so there will be no khums? please advise

Answer:

On your date of Khums, every amount which you own must be calculated whether the amount is in your hand on in the bank or with others as far as you have not lost it.

No Khums on that amounts of loan repayments if the house is where you live.

On the fixed day of khums i check my account,bag,purse and new thing which and pay khums on that is this is a right way ? or khums is only on savings?

Whatever remains with you after one year from getting the money, will be applicable for Khums.

Salam If a husband gives his wife money every month for her general maintenance and living expenses as she does not work and is a housewife, does she have to take out khums on this money if there is a surplus after a year? Or is it the husbands obligation to take out the khums on this money before giving to her? for example if I give my wife £200 each month what value of money should I give to khums? Also if one receives money from their parents at Eid time as a gift; is one required to take out khums from this money if there is a surplus after a year even if the parents are usually paying khums on their money? Answer:

If you earned the money during this year and your Khums date did not come
yet, you can use that money in Hajj or any other lawful purpose, with out
need to pay Khums. Khums is obligatory on your date of Khums or when one
year passes on earning that money if you have no date of Khums.

A1- Khums is obligatory on any new savings and not on the pure amount out
of which had been already paid previously. In your cast Khums is on $1200

A2- Not true. Khums is not Wajib on any amount or asset out of which you
have already paid Khums. Other amounts must be calculated for Khums.

AsSalaamun ale kum Dear Agha, I left my homeland and came to a foreign land to earn my livelihood; the rule of the foreign land is that I must return to my homeland once my work tenure is over. In my home land I do not have my own house and if I visit, I stay with my relatives, I’m saving for a basic need which has become very difficult as prices have risen a lot and the return to the homeland is inevitable. I’m the sole earning member and we are prepared as a family that at some point I might have to send my family back and if we are unable to meet family expenses. What is the khums treatment in my effort to meet my basic need where return to homeland is inevitable? I’m under the taqleed of Agha Sistani, I currently work in Gulf and come from India.

Answer:

=E2=80=8BKhums is obligatory on any extra amount which remains with you eve=
ry year
after spending on your and your family's lawful expences.=E2=80=8B If you d=
o not
have any extra amount then there no Khums on that year, and if you have any
extra amount, you must pay it's Khums and you will have then the rest 80%
for you to save for your future expences. Money collected for buying a
house in the future are not exempted from Khums, but if you buy or
construct a house and stay in it, that amount of such resident where you
are living in, is exempted from Khums.

If the saved money was with you for one year, then Khums is applicable on
it.

I will get 1/6th from the sale proceed that I intend to reinvest in other business. Do I have to pay khums before reinvesting in other business or khums will only be due if sale proceeds remains with me for one year.

Answer:

If this amount is your only capital for business for livelihood, then you
should invest it in a new business quickly and do not leave it with you
till your date of Khums.

Answer:

Salamun Alaykum wr wb
The house where you are living in now is exempted from Khums, but if you do
not practically live in it now, Khums will be obligatory on it's market
value on your Khums date.

Answer:

Khums is obligatory on every one who has any thing more than his livelihood
expenses. You must pay Khums for any amount which you saved in every year.
Your husband must do the same but you can not force him. You may tell him
that it is obligatory .

Asalam-o-Alikum, Hope by the grace of Allah, Muhammad (SAWW) and Aayl-e Muhammad (AS) you receive this email in good health. May Allah gives you strength and encompasses prosperity serving the Ummah. I am in taqleed of Ayatullah Sistani. I have been earning on my own since late 2002 and in between shifted from my home country to Dubai, got married and Alhamdulillah bestowed daughter by Rabul Izzat. During these years all I have earned was to fulfill my monthly expenditure and livelihood. My salary was little and had to rely on loans and credit card for fulfilling necessity and sometimes leisure and things beyond necessity as well. But had not accumulated any saving or investments as such. Till April 2015, I have been into same stream. Later on I changed my job in mid of April-2015 and got my salary for three months in end of July 2015 as lumsum amount (which I saved after deducting all expenditures , rent etc) and since August start receiving my monthly salary as well. Based on above, I need your guidance and way forward to calculate and pay KHUMS on my saving (accumulated from July-2015 till now) and any KHUMS I was supposed to pay earlier, which due to my ignorance or little knowledge on this subject and religious matter has skipped. Truly I believe it’s my ignorance and now need to correct the same. Secondly, I have now decided to set a date (Muharram) of this year to start calculating KHUMS, which I believe will be payable next year before Muharram. Appreciate if you could confirm the same is acceptable and how to proceed and calculate. Thank you in advance and anxiously awaiting your guidance.

Answer:

Accumulated salaries amount is usually used to pay for the debts for
livelihood expenses during those previous months. If any amount remains,
then Khums will be obligatory on it.
Your date of Khums should be same date when you started earning, then one
year after that , you must calculate if you have any amount saved or kind
unused. If you want to start from Muharram, you can do so but after paying
for the period from the start of your earning till Muharram.

Answer:

The amount which you have invested in a fixes deposit must be calculated
with your Khums calculations if that amount was not paid for Khums in the
past, i.e. if you have already paid Khums for the amount of investment, you
will not need to pay Khums again for that amount, but if you did not pay
Khums for that amount in the past, you must pay its Khums on your date of
Khums.

As Salaam Alaykum Syedna, My mother is connected with a charitable organisation in India, where they run an orphanage for ithna ashari orphans as well as educating poor ithna ashari children and getting ithna ashari girls married. The charity also has various other charitable projects like giving food parcels before the start of Ramazan. Can I give my khums contributions, both sehm e Imam and sehm e Saadaat to this charitable organisation as they do a lot of good work. Unfortunately there are very few charities especially for poor of the ithna ashari community, and Anjuman e Soghra could do with all the help they can get. Answer:

If the charity has a valid documented permission from the Marje of Taqleed
to receive Khums, you will be able to give them Khums.
Please provide the name and address of the charity so that we can
co-operate with them.

A1. Yes, all the amounts of Khums and Zakat which were due on you but you
did not pay on time, must be paid now.

Answer:

A1. Khums is an obligatory act on every Muslim who has earnings more than
his expenses. The yearly remaining amount must applied for Khums which 20%
of it. This Khums is divided into two equal parts ; one for the Imam who
spends it in serving people and religion, and the second part is for poor
Sadaat who are from the family tree of Bani Hashim.
Khums has been mentioned in Quran ( Surat Al-Anfal, verse 41).
Hundreds of authentic Hadeeths have come from the Prophet (SAWA) and Ahlul
Bayt (AS).

Selling your house: if the house is your residence, and you sell and buy
another house and live in it, then there is no Khums on house of residence.
If the house is not for residence but for any other purpose, Khums will be
applicable on it.

A4. You must pay Khums At least once every year. You may decide the date
and calculate all your ownership and pay 20% of it. The remaking 80% will
be pure money, and no Khums on it even in the future years. Only additional
amounts on that pure money, will be applicable for Khums in the future.
Keep in mind that Khums is nor a charity or donation, but it is Amanat with
us which must be given to its owners and when we give it, we are not
obliging any one, but giving back the right of other which has kept with us
as an Amanat.

Answer:

Khums is obligatory on you if you have any money or kind or asset after
spending your livelihood in every year. Jewelry which are used are exempted
like other expenses.

If all your earnings are spent for your livelihood within the year, then no
Khums.

Fitra to poor people in other places either directly or through trusted
persons or trusted organizations..

Question:

Salaam Sir, I have £80 000 inheritance money that I wish to buy a house for rental. Is Khums applicable? Can I buy a house and then slowly pay the khums amount over a few years? Thank You

Answer:

There is no Khums on inherited wealth or property if the deceased has
already paid its Khums. If he did not pay its Khums, then Khums must be
paid first before touching the money.
In case Khums was paid, you are allowed to buy a property for rental income
from your inherited money, and use the income for your livelihood, and if
any amount remains from the income, Khums will be obligatory on that
remaining amount.

Question:

As-Salaamun-Ale-Kum, I stay in a foreign land in a rented accommodation. Our 1 room accommodation in our homeland is not in a condition where my wife and kid can stay, my aunt and my mother are the present owners of the house. Keeping this in view I told my wife before marriage that we will not stay there. The house is on nominal rent divided between my aunt and mother. We are saving to buy a house in our homeland, is khums applicable on this money. Was-Salaam

Answer:

Yes, Khums is applicable because the saved money has not yet been used in
buying a residence and staying in it.

Question:

Salamun Alaikum! I wish to clarify an important point with respect an Imam Juma-o-Jamaat of a small town to which I am related through my in-laws. He is unable to meet his daily expenses based on the income from Hauze Ilmiya for his services. Is it allowed to give him some portion of our sehme Imam, so that he make his both ends meet easily?

Answer:

Using Sahm e Imam (AS) needs a permission from Marje of Taqleed.
