Answer:

Yes. Khums is obligatory on every savings whether from your business or
gifts from husband or others.

Question:

I have received a Khums guide from reputable Shia organisations and there is something that deeply confuses me. There is no mention of subtracting ones expenses from Khums, there is only mention of subtracting the "remainder of last year's savings in which Khums was already paid" from the present years total income. I have never seen this before, can you recommend a step by step guide on how to calculate Khums please? Thank you & Duas.

Answer:

Khums of every year is calculated from what you have or own now ( which is
the amount of your income minus what you have already spent for livelihood
or usual expenses). If this remainder amount includes previous year or
years amounts out of which you have already paid Khums, then amounts which
are previously purified should excluded, then the new net income only (
which means net savings of this year) is to be applied for this year

Salaamalaykum. May Allah (SWT) bless you and your family. When paying Khums, is it better for me to let the charity and his eminence Ayatullah Sistani (my Maraja) to decide where to spend the Khums? My dilemma is that I do not know where Khums is needed most and I have been given the option by charities to give Khums for different causes helping needy Shias in different countries. Answer:

If you do not know where Khums is more needed, you should seek help from
Marja' of Taqleed or his deputies send the Khums to him as he knows much
more than you where are the needy places.

Answer:

Sahm e Imam is to be paid to the Imam of the time; who is now Imam Al Mahdi
(AS) or his deputies who are the Marjas of Taqleed or their authentic
deputies. You may seek permission from the Marja to spend part of Sahm e
Imam in genuine service to Islam or poor.
Sahm e Sadat is the share and the right if poor Sadat.byou may give to them
either directly if you know really deserving Sadat, or through reliable
Ulama who will make it reach to deserving Sadat.

I had given my khums Payment(Both Sehme Imam and Sehme Sadaat) to my relative in City where Aqai Sistani authentic wakeel is living.He gave him after Prayer in Masjid and did not take the reciept.I am certain about this handing over of money to wakeel by my relative.Is it enough? Is my namaz and other obligations right if this khums payment includes khums on sajdahgah and Musallah?

Answer:

After paying your due Khums, all your use of the remaing amount will be
valid Insha Allah.
If your cousin can get you receipt, it will be good.

Answer:

Khums is obligatory on you for any weal or kind that you own, whether the
money or kind is in your hands or your bank account or with others as far
as you are the owner and the money is not lost.

Assalamu alaikum, I have a question regarding zakat and khums. My annual zakat and khums that I need to pay is due in August. However, I am currently saving money to buy a house to live in which I may buy in September (Allah willing). My question is do I still need to pay zakat and khums on these savings for the house, even tough this would means that I will no long be able to buy the house in September and will have to wait long to save the money again? Answer:

As far as you did not buy and reside at the house ich you intend to
buy, all the money which will be with you on the date of Khums, must be
calculated for Khums purpose.

Question:

Salamun-alaikum I am muqallid of Ayatullah Sistani. If a person is depositing a certain amount every month in Recurring Deposit or in other schemes for say 10 years and after that 10 years that service provider or bank returns the full amount with some interest. What is ruling of Khums on it? Should that person take out the khums on the part of amount he deposited in his annual khums cycle or he should take out the khums after getting the whole amount in hand? (Please note that one can not easily withdraw/cancel these type of schemes before the completion of the fixed duration.)

Answer:

Khums for the whole amount must be paid immediately because it was in the
bank for more than year.

salaam u alaykum, does khums have to be paid on an overdraft ? i have a £500 overdraft amount with my bank which they have lent to me so I can use it, I do not have a job and am living with family so dont have many expenses, if for example the savings I have are only the overdraft amount do I have to pay khums or zakat on this amount ?

Answer:

The overdraft amount is not owned by you but just a right to borrow that
amount from the bank. As far as you do not own the amount, there is no
Khums on such amount.

When calculating Khums, do I take into account as my expenses, the tax that the non-Muslim government takes from my salary? So for example, before tax if I earn £2000 in a month, 20% gets deducted by the government as tax which is £400, leaving me with £1600 after tax. Do I count that £400 tax as an expense along with bills, shopping etc. and deduct that total from the £1600 and what ever remains as surplus take 20% from that as Khums? Thanks. Wassalam

Answer:

What ever you pay to the government as tax is part of your expenses. Khums
is obligatory on the remaining amount after your expenses.

Can we give the Sahm e Sadaat portion of khums to a needy Syed to help him , without informing him that this is khums money? If No, then what should be done before giving him such money? Thanks.

Answer:

It is not necessary to inform the poor Sayyed when giving him Sahm e Sadaat
that it is Khums money.
You must be sure that he is a poor Sayyed and give him the Sahm e Sadaat
for the sake of Allah (Qurbatan Ilallah).

Answer:

Helping your poor relatives is very important and it must be given more
importance than helping other poor person if your relatives are really in
need.
Khums is two parts i.e Sahm Imam (AS) and Sahm Sadat. If your poor
relatives are Sadat, you can give them from Sahm Sadat. If your poor
relatives are not Sadat, then you need to seek permission from your Marja'
of Taqleed to give part of Sahm Imam (AS) to them.
It is great reward to help your poor relatives from your own money (the 80%
which remains with you after paying your obligatory Khums).

What ever you remains from your salary or any other income, Khums will be
obligatory on it once every year.
Zakatul Fatra is also obligatory on the eve of Eid ul Fitr.

Salaamalaykum. I incorrectly used to think that Islamic Tax was Zakat 2.5% on any new earnings and was giving this each month for three years. I now realise that it should have been Khums 20% on any new earnings and certain un-used items. For the years I paid 2.5% how should I proceed, for example, should I give the remaining 17.5% for those years or does it need to be 20% as the intention back then was incorrectly Zakat? Yes, you have to complete the due amounts of Khums which are 20%..

Assalamalaykum, I am under the Taqleed of Ayatollah Seestani.My husband has kept Rs 25 Lakh as a fixed deposit in an Indian Bank since last 2 years.We get an annual interest of 9% on a monthly basis.We did not put any condition as such in front of the bank to pay us this much.We have absolutely no other source of income.We use the interest thus generated for our daily expenses and to support our large family.My queries are as under: 1-Is the interest Halal or Haram? 2.Can this money be used for religious functions like Nazaro Niaz,Majlis e Isaal e Sawaab etc? 3.What are the Khums ahkam on such interest received and for the entire amount of Rs 25 Lakh at the end of the year? Jazak Allah Hope for a speedy reply. Feeamanillah.

Answer:

Interest given by non Muslim bank is allowed.
Lawful money can be spent in religious purposes.
Khums must be paid at the end of the year,so, the whole amount of 25 must be applied for Khums as it is with you since more than year. The income which is received must be calculated if any thing remains after spending your lawful usual expenses.

salaam, what is the ruling on giving charity to non muslim charities who are helping people and providing food for the needy here in UK, sometimes they are doing more work then some muslim charities who take might take money for themselves ?? can we give our old clothes to the non muslim charity shops for them to sell or should we give to muslim people ?

Answer:

If you are sure that they make your donation reach to the poor and needy
with out any religious discrimination or religious colour, then you can
give it through them. The problem with many non Muslim organizations is the
agendas which they have according to their own thinking which does not
always go along with Islamic faith to help every human being with out any
discrimination. It is better to look for sincere Muslims who can make your
donation reach to the real needy. Keep in mind that charity starts at home,
so try to make your donation help the needy who are near to you first.

If the Islamic Center has a permission from the Marja of Taqleed to receive
Khums, then you can give them according to the permission. If they do not
have a valid permission, you need to seek permission before using Sahm e
Imam in any project or good cause.

My question is: If I have been given money by my parents on which they have paid khums is it necessary for me to pay khums at the end of the year if the money is surplus for me? Answer:

As you have become the new owner of that money, any amount remaining from
that money after one year or on your Khums date, must be included in Khums
calculations, means you must pay its Khums.
There is no difference whether the previous owner paid or did not pay Khums
when he was the owner.

Answer:

If the amount was given to the needy Sayyed with the intention of Sahme
Sadaat, then it can be calculated from Khums. If it was given with another
intention, then it will not be possible to make it with Khums later on.
