Question:
Salamun-alaikum I am muqallid of Ayatullah Sistani. If a person is depositing a certain amount every month in Recurring Deposit or in other schemes for say 10 years and after that 10 years that service provider or bank returns the full amount with some interest. What is ruling of Khums on it? Should that person take out the khums on the part of amount he deposited in his annual khums cycle or he should take out the khums after getting the whole amount in hand? (Please note that one can not easily withdraw/cancel these type of schemes before the completion of the fixed duration.)
Answer:
Khums for the whole amount must be paid immediately because it was in the
bank for more than year.

Khums must be given to the Marja' of Taqleed or any of his authentic
deputies who are authorized to receive and distribute Khums.

salaam u alaykum, does khums have to be paid on an overdraft ? i have a £500 overdraft amount with my bank which they have lent to me so I can use it, I do not have a job and am living with family so dont have many expenses, if for example the savings I have are only the overdraft amount do I have to pay khums or zakat on this amount ?
Answer:
The overdraft amount is not owned by you but just a right to borrow that
amount from the bank. As far as you do not own the amount, there is no
Khums on such amount.

Question:
When calculating Khums, do I take into account as my expenses, the tax that the non-Muslim government takes from my salary? So for example, before tax if I earn £2000 in a month, 20% gets deducted by the government as tax which is £400, leaving me with £1600 after tax. Do I count that £400 tax as an expense along with bills, shopping etc. and deduct that total from the £1600 and what ever remains as surplus take 20% from that as Khums? Thanks. Wassalam
Answer:
What ever you pay to the government as tax is part of your expenses. Khums
is obligatory on the remaining amount after your expenses.

Question:
Can we give the Sahm e Sadaat portion of khums to a needy Syed to help him , without informing him that this is khums money? If No, then what should be done before giving him such money? Thanks.
Answer:
It is not necessary to inform the poor Sayyed when giving him Sahm e Sadaat
that it is Khums money.
You must be sure that he is a poor Sayyed and give him the Sahm e Sadaat
for the sake of Allah (Qurbatan Ilallah).
