Question:

I have 1/6th share in a business. My other partners are either non Muslims or Sunni Muslims. We are now planning to sell this running business to a third party. I will get 1/6th from the sale proceed that I intend to reinvest in other business. Do I have to pay khums before reinvesting in other business or khums will only be due if sale proceeds remains with me for one year.

Answer:

If this amount is your only capital for business for livelihood, then you
should invest it in a new business quickly and do not leave it with you
till your date of Khums.

Question:

Asak,I did not have access to my jewellry for over a year now (its with my Mother in law in her bank locker as we find it unsafe to carry it) and I am staying abroad. In such a scenario what are the obligations on me regarding khums.

Answer:

its current value for Khums payment.=E2=80=8B
You must pay Khums for your unused jewellery as you did not use it for one
year or more.

Question:

Asak, I have purchased one flat in banglaore for purpose of living but i have still not got its possession and as per current estimate it will take another 1.5 to 2 years. Meanwhile my office location has changed and now my home is quite far from my office and commuting takes lot of time due to distance and traffic. Due to this I am thinking of buy another ready to move in flat near my office.My question is that Do I have to pay khums on this 2nd house monthly loan installments? Kindly advise.

Answer:

Salamun Alaykum wr wb
The house where you are living in now is exempted from Khums, but if you do
not practically live in it now, Khums will be obligatory on it's market
value on your Khums date.

Question:

Sir, My husband is a religious man, Alhamdolillah. He does a lot of charity. But somehow he never wanted to pay khums. We had a lot of arguement on this issue. I used to work for quite sometime. That time I asked a lady who knows religion more than me whether I can pay khums from my salary. She said yes you can. I gave khums without telling my husband. Astaghfirullah. But now we both are retired. My husband is sick. We have some saving (FD) and also we get some money in the form of rent every month. How do I solve this problem and what about the years during which I have not paid khums. We follow Aqaae Shistani. I am in a confused state of mind. I donot want to create any problem in the house since my husband is not well. Please advise. Thank you

Answer:

Khums is obligatory on every one who has any thing more than his livelihood
expenses. You must pay Khums for any amount which you saved in every year.
Your husband must do the same but you can not force him. You may tell him
that it is obligatory .
